Terms of Service

These Terms of Service (“Terms”) govern your access to and use of 833fixedrv.com (the “Site”), the 833-FIXED-RV telephone line, and any associated services (collectively, the “Services”) operated by Schwalm Inc. under the 833-FIXED-RV brand (“we,” “us,” or “our”).

Please read these Terms carefully. By accessing or using our Services — including by calling 833-FIXED-RV or submitting a request — you agree to be bound by these Terms. If you do not agree, do not use our Services.

1. The Services

833-FIXED-RV operates a toll-free telephone line and an automated phone assistant that connect RV owners who need repair, maintenance, or roadside help with independent third-party repair shops, mobile RV technicians, and towing services (each, a “Partner”). When an RV owner contacts us, we gather details about the problem and the owner's location and route the request to one or more Partners we believe can help.

For RV owners, the Services are provided free of charge. Partners pay a per-referral fee as described in Section 6. We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice, without liability to you or any third party.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is greater) to use our Services. By using our Services, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms. If you use the Services on behalf of a business (for example, as a Partner), you represent that you are authorized to bind that business to these Terms.

3. We Are a Referral Service — Not a Repair Provider

833-FIXED-RV is solely a referral and connection service. We do not perform, supervise, inspect, or control any repair, maintenance, roadside, or towing work. Partners are independent businesses. They are not employees, agents, partners, joint venturers, or representatives of Schwalm Inc., and we do not employ, license, or guarantee them.

Any agreement for services, pricing, scheduling, payment, warranty, or the work itself is solely between you and the Partner. We do not guarantee the availability, quality, safety, timeliness, licensing, insurance, pricing, or outcome of any work performed by a Partner, and we are not a party to any transaction between an RV owner and a Partner. While we may screen Partners before adding them to our network, screening is not a guarantee, endorsement, or warranty of any Partner's work. You are responsible for evaluating any Partner and the work they propose before authorizing it.

We do not guarantee that a suitable Partner will be available for any request, in any location, or within any timeframe.

4. Calls, the AI Assistant, and Recording

Calls to 833-FIXED-RV are answered and handled by an automated, AI-powered phone assistant, which may collect and process the information you provide (including your phone number, a description of your RV problem, vehicle details, and your location). Calls and their transcripts may be recorded, stored, and processed to operate the Services, route your request to Partners, provide support, and improve the Services.

By calling 833-FIXED-RV or otherwise using the Services, you consent to the use of an automated assistant and to the recording, transcription, storage, and processing of your call and the information you provide, and to our sharing that information with one or more Partners so they can contact you and provide service. If you do not consent, do not use the phone line. How we handle this information is described in our Privacy Policy.

5. For RV Owners

There is no charge to RV owners for calling 833-FIXED-RV or being matched with a Partner. You are responsible for any amounts you agree to pay a Partner directly for parts, labor, towing, or other services. We are not responsible for collecting, refunding, or mediating those payments, and any dispute about a Partner's work or charges is between you and the Partner.

6. For Partners — Referral Fees and Billing

If you register as a Partner, the following additional terms apply:

  • No signup or monthly fees. There is no fee to join the network and no recurring subscription. You pay only a per-referral fee for leads we send you.
  • Card on file. You authorize us and our payment processor (Stripe) to securely store a payment method on file and to charge the applicable per-referral fee for each referral, in accordance with the pricing disclosed to you when you join or as later updated.
  • Authorization to charge. By keeping a card on file, you authorize recurring per-referral charges to that payment method. You are responsible for keeping your payment information current and for all applicable taxes.
  • Accurate information. You represent that your business holds any licenses, permits, and insurance required to perform the services you offer, and that the information in your account is accurate and current.
  • Workmanship Guarantee responsibility. If you perform a repair that is covered by our $2,500 Workmanship Guarantee (Section 18.1) and the workmanship proves defective, you agree to correct it at no additional charge to the RV owner. If you fail to do so, you authorize us and our payment processor to charge your payment method on file for the reasonable cost of correcting that workmanship, up to $2,500 per repair, and to offset such amounts against future referrals.

We may change per-referral pricing prospectively on notice. Continuing to accept referrals after a price change takes effect constitutes acceptance of the new pricing.

7. Refunds

Referral fees are evaluated for refund or credit on a case-by-case basis. If you believe a referral fee was charged in error or a referral did not meet the agreed criteria, contact us at hello@833fixedrv.com and we will review your request. Approval of any refund or credit is at our reasonable discretion.

8. Account Registration

To access certain features (such as the Partner portal), you must create an account. You agree to provide accurate, current, and complete information, maintain the security of your credentials, promptly notify us of any unauthorized access, and accept responsibility for all activity under your account. You may not create an account for someone else without permission or use another person's account.

9. Acceptable Use

You agree not to:

  • Use the Services for any illegal, fraudulent, or unauthorized purpose
  • Submit false, misleading, or fraudulent repair requests or referrals, or attempt to avoid referral fees
  • Interfere with or disrupt the Services, the phone line, or servers
  • Attempt to gain unauthorized access to any part of the Services
  • Use automated means (bots, scrapers, auto-dialers) to access or overload the Services or telephone line
  • Use the Services to send spam, malware, or other harmful content
  • Harass, abuse, or threaten our staff, our Partners, callers, or others through any feature of the Services
  • Violate the privacy or intellectual property rights of others

We reserve the right to investigate and take appropriate action against any violation, including suspending or terminating your account or access.

10. Intellectual Property

The Services, including the Site, its content, design, logos, and trademarks, are owned by Schwalm Inc. and are protected by intellectual property laws. Except for the limited right to use the Services as intended, no rights are granted to you by implication, estoppel, or otherwise. The “833-FIXED-RV” and “833-FIXED-RV” names and related logos are our trademarks and may not be used without our prior written permission.

11. Third-Party Services

Our Services rely on third-party providers (including, for example, our AI phone assistant and telephony providers, Stripe for Partner payments, Supabase for accounts and data, Resend for email, and Vercel for hosting), and may link to Partner or other third-party websites. We are not responsible for the content, terms, or practices of these third parties, and your use of any third-party service is governed by that provider's own terms and policies.

12. Disclaimers of Warranty

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND COURSE OF PERFORMANCE.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT A PARTNER WILL BE AVAILABLE, OR THAT ANY WORK PERFORMED BY A PARTNER WILL BE SATISFACTORY. WE EXPRESSLY DISCLAIM ANY LIABILITY FOR THE ACTS, OMISSIONS, OR WORK OF ANY PARTNER. YOU USE THE SERVICES AND ENGAGE ANY PARTNER AT YOUR OWN RISK.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL SCHWALM INC., ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, PROPERTY DAMAGE, PERSONAL INJURY, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS, YOUR USE OF THE SERVICES, OR ANY WORK PERFORMED BY A PARTNER, REGARDLESS OF THE LEGAL THEORY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

14. Indemnification

You agree to indemnify, defend, and hold harmless Schwalm Inc. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, any work or transaction between you and a Partner, your violation of these Terms, or your violation of any third-party rights.

15. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Services will immediately cease. You may stop using the Services at any time, and Partners may close their account through the portal or by contacting us. Sections that by their nature should survive termination (including Sections 3, 10, 12, 13, 14, and 16) will survive.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of laws principles.

Any dispute arising out of or related to these Terms or the Services shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction. Any claim or cause of action arising out of these Terms or the Services must be filed within one (1) year after it arose, or be forever barred.

17. General Provisions

Entire Agreement — These Terms, together with our Privacy Policy, constitute the entire agreement between you and Schwalm Inc. regarding the Services.

Severability — If any provision is held invalid or unenforceable, the remaining provisions will continue in full force and effect.

Waiver — Our failure to enforce any right or provision will not be deemed a waiver of that right or provision.

Assignment — You may not assign these Terms without our prior written consent. We may assign these Terms freely.

No Agency — Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and us, or between us and any Partner.

18. Promotional Offers (RV Owners)

From time to time we offer promotional incentives to RV owners. The offers below are our current promotions and are provided in addition to the free referral service. Except where a specific benefit is expressly described here, these promotions do not change Section 3 — 833-FIXED-RV remains a referral service and is not the repairer or a party to any repair. Each promotion is limited to one per household, RV, and repair incident; has no cash value except as stated or required by law; may not be combined with other offers unless we say so; is void where prohibited; and is available only to RV owners using the Services as intended (not to Partners or their affiliates). We may modify, suspend, or end any promotion at any time. To the extent a promotion conflicts with the general disclaimers in Sections 12 and 13, that conflict is resolved only as to the specific benefit expressly described below.

18.1 $2,500 Workmanship Guarantee

What it is. If the workmanship on a covered repair completed by a registered Partner booked through the Services proves defective, we will help arrange corrective work and, subject to this Section, cover the reasonable cost of correcting that workmanship up to a total of $2,500 per repair. This is a limited service commitment from 833-FIXED-RV. It is not insurance, not a warranty of any Partner's work, and does not make 833-FIXED-RV the repairer.

Who pays. The Partner who performed the work is primarily responsible for correcting defective workmanship at no additional charge to you. If the Partner fails to do so, Schwalm Inc. will, in its reasonable discretion, arrange and cover the reasonable cost of corrective workmanship up to $2,500, and the Partner has authorized us to recover those amounts from the Partner (Section 6). You are never asked to pay twice for the same covered workmanship.

Scope — what is covered. The guarantee covers defects in a Partner's workmanship (the quality of the labor) on a repair that was (a) requested through 833-FIXED-RV, (b) performed by a Partner who was registered with us at the time of the work, (c) paid for by you, and (d) reported to us within ninety (90) days of completion.

Scope — what is not covered. The guarantee does not cover: parts, components, or materials, or their failure, except to the extent the failure was caused by the Partner's workmanship; manufacturer or design defects; pre-existing conditions or unrelated issues; damage from misuse, accident, weather, road hazards, neglect, or continued operation after a defect was known; routine maintenance, wear, or cosmetic items; any indirect or consequential losses (including towing, lodging, lost use, missed trips, or downstream damage); work not booked through the Services; work performed by anyone who was not a registered Partner at the time; and any amount above $2,500 in the aggregate per repair.

Conditions. To make a claim you must notify us at hello@833fixedrv.com within the 90-day window, give us and/or the Partner a reasonable opportunity to inspect and correct the work, and not authorize third-party repairs of the covered workmanship before we respond. All determinations of coverage, whether a defect exists, and the reasonable cost of correction are made by us in our reasonable discretion. The guarantee is void if the information you provided is false or the claim is fraudulent.

18.2 $25 RV Water Filter Store Gift Card

What it is. Eligible RV owners may receive a $25 gift card redeemable at rvwaterfilterstore.com — a store owned and operated by Schwalm Inc. — toward the purchase of a new RV Water Filter Store filtration system.

Eligibility — completed jobs only. The gift card is issued only after (a) you were matched through the Services with a registered Partner and (b) that Partner completed a paid repair for you. It is not available for calls, quotes, or referrals that do not result in a completed, paid job through a registered Partner. Limit one gift card per household, RV, and repair incident.

Redemption and restrictions. The gift card is redeemable only at rvwaterfilterstore.com toward a new RV Water Filter Store filtration system; it is not redeemable for cash (except where required by law), is not transferable, and may not be combinable with certain other offers as noted at checkout. It is subject to rvwaterfilterstore.com's own terms of sale and to any expiration date stated when it is issued. Applicable taxes and shipping are your responsibility, and you are responsible for any taxes that may apply to the value received. We may substitute a gift card of equal value or end this offer at any time. Void where prohibited.

19. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on our Site before the changes take effect. Your continued use of the Services after the effective date of any update constitutes your acceptance of the revised Terms.
